A CHARTER ORDINANCE EXEMPTING THE CITY OF TOWANDA, KANSAS, FROM THE PROVISIONS OF K.S.A. 12-4112 AND AUTHORIZING AN ASSESSMENT OF COURT COSTS IN THE MUNICIPAL COURT OF TOWANDA, KANSAS.

WHEREAS, the provisions of K.S.A. 12-4112 apply to the City of Towanda, Kansas, but are not applicable uniformly to all cities within this state, and

WHEREAS, it is deemed advisable by the governing body of the City of Towanda, Kansas, to assess costs to pay for the increased expenses for the city’s administration of justice.

Section 1. The City of Towanda, Kansas, pursuant to the authority of the constitution of this state hereby exempts Towanda, Kansas, from the provisions of K.S.A. 12-4112. In each case brought within the municipal court of Towanda, Kansas, there shall be costs assessed to such party as the court shall designate to defray the administrative expenses incurred therein.

Section 2. Costs shall be fixed at a base amount as follows:

$5 - Minor traffic violations including speeding less than 25 miles per hour over posted limit.

$10 - Speeding over 25 miles per hour over posted limit.

$25 - Serious Traffic violations and non-traffic offenses.

Section 3. In addition thereto, court costs may include such additional amounts as may necessarily be spent to compel the attendance of witnesses, including expert witnesses, and may include such other expenses reasonably necessary within the discretion of the court for the administration of justice.
